ConvoPhoto – Terms & Conditions (Ontario)

These Terms & Conditions apply to all purchases made from ConvoPhoto. By placing an order, you confirm that you have read, understood, and agreed to these terms.
These terms are governed by the laws of the Province of Ontario and applicable federal laws of Canada.
1. About Custom Photographic Products
All ConvoPhoto products are custom photographic goods created specifically for the customer based on the selected images, products, and specifications provided at checkout.
2. Pricing, Payment & Taxes
- All prices are listed in Canadian dollars (CAD).
- Payment in full is required at the time of purchase.
- Applicable HST and shipping fees are calculated and displayed before checkout is completed.
- Once payment is processed, the order enters production and cannot be cancelled.
3. All Sales Final – Custom Goods
In accordance with the Ontario Consumer Protection Act, refunds are not required for custom-made or personalized goods, except where required by law.
Because all ConvoPhoto products are custom:
- All sales are final
- No refunds, returns, or exchanges are offered once an order has been submitted
except in cases of production error (see Section 7).
This does not affect your statutory rights under Ontario law.
4. Image Selection, Cropping & Colour
- Customers are responsible for reviewing image selections, crops, and products before checkout.
- Screen previews are representations only.
- Minor variations in colour, brightness, or cropping between screen and final print are normal and not considered defects.
- Such variations do not qualify for refunds or reprints.
5. Digital Images & Licensing
- Digital image purchases are licensed for personal, non-commercial use only.
- Digital files may not be sold, redistributed, altered, or used commercially without written permission from ConvoPhoto.
- Due to their nature, digital downloads are non-refundable once delivered.
6. Shipping & Delivery
- Production and shipping timelines are estimates only.
- ConvoPhoto is not responsible for delays caused by shipping carriers, weather, labour disruptions, or other events beyond our control.
- Customers are responsible for providing accurate delivery information.
- ConvoPhoto is not liable for lost or delayed shipments once orders are handed to the carrier.
7. Production Errors & Remedies
If you receive a product with a verifiable production error, you may be entitled to a remedy under Ontario law.
Production errors include:
- Incorrect image
- Incorrect product
- Printing defects or damage during production
To request a remedy:
- Contact ConvoPhoto within 7 days of delivery
- Provide clear photographs of the issue
If approved, ConvoPhoto will provide a reprint or replacement at no additional cost.
Preference-based concerns (pose choice, expression, personal appearance) are not production errors.
8. Privacy & Personal Information
- Personal information is collected and used solely for order processing, fulfillment, and customer support.
- Student images and personal data are handled securely and are not sold or shared with third parties.
- Password-protected galleries may be used to safeguard privacy.

9. Image Availability & Retention
- Image galleries are available for a limited time.
- ConvoPhoto does not guarantee long-term image archiving.
- Customers are responsible for placing orders before gallery expiration.
10. Limitation of Liability
To the extent permitted by Ontario law:
- ConvoPhoto’s liability is limited to the amount paid for the product in question.
- ConvoPhoto is not liable for indirect, incidental, or consequential damages.
Nothing in these terms limits rights that cannot be excluded under the Ontario Consumer Protection Act.
11. Governing Law
These Terms & Conditions are governed by the laws of Ontario, Canada.
12. Acceptance of Terms
By completing your purchase, you acknowledge that you have read and agreed to these Terms & Conditions.
